According to the amendments stipulated by Legislative Decree /42/ of 1961, the Republic Vice-President: Pursuant to President Resolution /1957/ of 1959 delegating some authorities to the Vice-President; And the Law /1/ of 1958 involving some amendments on the existing legislations in Syria & Egypt territories, and amended by the Law /242/ of 1960; The basic Law of employees /135/ of 1945 and its amendments; Legislative Decree /75/ of 1947 concerning with MOF personnel and its amendments; Law /55/ of 1959 about organizing the State Council in United Arab Republic (UAR); Law /56/ of 1959 about judiciary; Law /58/ of 1959 about organizing the state issues management; Law /36/ of 1960 about the insurance and pensions of civil state employees; Law /230/ of 1960 issuing the Accounting Divan Law and its amendments; Republic President resolution /477/ of 1959 about the responsibilities of central Treasury Ministry; Republic President resolution /194/ of 1960 about the Customs in UAR; Republic President resolution /1328/ of 1960 about the specialties of ministerial committee of planning affairs; Republic President resolution /2024/ of 1960 about creating the ministerial committee of planning affairs in the Syrian territory; and The State Council opinion, Decides the following:
Article 1: Without prejudice to the specific specialties of central Treasury Ministry according to the president of the republic resolutions: /477/ of 1959, /194/ of 1960, /1328/ of 1960 and /2024/ of 1960 cited above, the MOF in the Syrian territory practices the following authorities: 1. Preparing and paying the draft of ordinary and developing budget and the attached and independent budgets in the Syrian Arab Republic 2. Auditing the other budgets SAR financing, prior to presenting them to the relevant authorities to approve, and monitoring paying them. 3. Preparing all drafts of financial laws and regulations and giving an opinion on them 4. Giving an opinion on the drafts of international agreements which resulting in financial commitments 5. Managing, supervising and ensuring to collect the public revenues 6. Clearing the Treasury Ministry expenditures and pensionary rights without contradiction to the Law provisions of insurance and pensions Fund 7. Auditing all public spending documents and expending them but what were excepted by the special laws and regulations 8. Managing the public funds movement, the works and accounts of Treasury 9. Managing the public debt fund 10. Inspecting and investigating about financial affairs of the public administrations and institutions, the institutions having privilege and those which work partially or fully by public funds or by the state bail or guarantee 11. practicing all authorities of Ministry of Treasury according to the laws and regulations Article 2: Taking into account the authorities and competencies practiced by MOF staff, according to effective regulations, the Treasury Minister shall handle the authorities and competencies related to his ministry. He shall be the highest directional and supervision reference for all employees and works, to ensure proper implementation within the laws and regulations in force. Article 3: The Minister is assisted in Ministry works by: a ) Secretary-general who heads all administrations in the Ministry, and is technically and administratively responsible to the Minister for works process, directly controls administrations works within the laws and regulations extent and signs on transactions but those which related to guiding and organizing affairs, as he ticks before Minister signs them. b ) One assistant secretary-general or more, and the specialties are distributed among the secretaries and assistants by a Minister’s decision. Article 4: In the Treasury Ministry, an Advisory Council shall be created and charged with the following assignments: a ) Studying basic projects of public revenues and financial organization and affairs b ) Concluding the reconciliation by the way of settlement or arbitration when the Treasury interest requires these, without prejudice to special provisions of State Council and State Cases Management c ) Making decision about the partial or full exemption requests submitted by staff or accountants against who an order of amercement was issued by accounts divan d ) Making decision about attachment removal requests before issuing a judicial sentence containing the innocent or non-responsibility Article 5: a ) The Advisory Council consists of: - Secretary-general as a president - The assistant Secretary-generals and the most senior is Vice-president - The directors in the central administration as members - Reporter to be nominated by the Minister b ) The Council meets by a call from the Minister or secretary-general, and the Minister chairs the sessions he attends. c ) The Council proposals are executed by a Minister’s decision. Article 6: In the Ministry of Treasury, an especial office for the Minister is created and its specialties are defined by a ministerial decision. Article 7: 1. the central administration consists of the following departments: a ) Financial inspection department b ) Administrative affairs department c ) Financial affairs department d ) Public revenues department e ) Public budget department f ) Public debt box department g ) Central Treasury department 2. Each department is headed be a director who manages and monitors his department, and is responsible for the work process progress, ticks on all transactions produced by his department and signs on the transactions in behalf of the Minister or secretary-general within the delegation extent he has been granted. The director is assisted by assistants or heads of sections, one of them represents him if he is absent by a delegation from secretary-general.
