A mayor report certifying the death incident and duly submitted by the forensic judge to the Civil Register and Damascus directorate of finance, with the personal data of the dead person 1. and his inheritors fixed on the report. 2. checking the availability of a file for the dead containing the death certificate fixed in the Civil Register. 3. In accordance of the above report, each inheritor has the right to get: a. Inheritance statement (form 39/d modified) stating information about the dead person, his inheritors and the applicant, in addition to all the movables and immovables related to the dead person. The statement is referred to the temporal register to check the dead person’s name in the alphabetical index and show his/her real estate property.
b. Inheritors are notified to present a document of legal or Miri limitation of succession within 30 days as of the notification day. c. A declaration by the inheritors that the statement they have presented contains all movables and immovables belonging to the dead person. d. An income letter directed to the fixed income and real profits sections to show whether the dead person was levied by them.
In the case that the dead person owned a car, a letter is directed to the transport directorate to show the car type and the dead person’s share in it. After completing the inheritance statement by the Real Estate Service Directorate, and the temporal register and financial register, the mayor’s report is sent to the forensic court to obtain a forensic limitation of succession or to the magistrate’s court to obtain a legal limitation of succession, according to the type of the property owned by the dead person.
1. After bringing the limitation of succession, the dead person’s file is sent to the relevant controller according to the alphabetical letter of the second name in order to study the file and determine the duties imposed on the inheritors.
